Your safety and happiness are of the utmost importance to Wild Scottish Weddings. By choosing to use our services, you agree to the following Terms and Conditions.
Definitions
"Wild Scottish Weddings", "we", "us" and "our" means Wild Scottish Weddings.
"Client" means the individual(s) entering into the agreement for services. Where more than one Client enters into this Agreement, each Client shall be jointly and severally liable for all obligations arising under it.
"Supplier" means any third-party provider of venues, accommodation, transport, officiants, photographers, florists, musicians, catering, or other goods and services.
"Services" means the wedding planning, coordination and related services detailed in the Client's booking contract, confirmation and invoice.
"Wedding" includes weddings, elopements, vow renewals and civil ceremonies where applicable.
Outdoor Weddings
Clients acknowledge that outdoor and remotely located weddings may involve uneven terrain, changing weather conditions, wildlife, natural hazards and limited access to phone reception & emergency services. Participation is entirely voluntary and Clients and their guests acknowledge and accept the inherent risks associated with outdoor and remote-location ceremonies. Clients acknowledge that weather conditions, terrain and access limitations may require alteration of ceremony locations, photography locations and timings at short notice.
Our Services
The Wild Scottish Weddings Planning Service,
An initial video consultation, followed by reasonable support by email, telephone and video consultation during normal business hours until the wedding date.
Assistance with securing permission from the relevant landowner for your outdoor ceremony location. Please note, the landowner may charge you a fee to host your ceremony.
Arrangement of an indoor contingency ceremony location (plan B) in the event of adverse weather conditions, where available and required.
Assistance in selecting and booking, where requested by the Clients:
o A legal or non-legal wedding officiant.
o Professional photography and/or videography services.
o Floral arrangements from local florists.
o Musicians, including bagpipers and violinists.
o Hair and make-up services.
o Accommodation for the couple and their guests.
o A reception venue for dining and entertainment. Please note that responsibility for organising the reception remains with the Client.
Liaison with Suppliers to ensure arrangements are in place.
Suggestions for incorporating traditional Scottish elements into your ceremony.
A tree planted in the Wild Scottish Weddings grove with Trees for Life.
A video consultation in the weeks leading up to your wedding to confirm and finalise arrangements, including the wedding day schedule.
Wedding Day Services,
The following services may be available, subject to availability and wedding location. Prices are available upon request:
Wedding support including help to get ready and the honour of acting as your witnesses if you would like us to.
Guiding to your ceremony location and additional photography locations.
Collection and delivery of your food and flowers on the day.
Looking after dogs during your ceremony.
Inclusion of and serving of an outside picnic including use of the Wild Scottish Weddings picnic blankets, plates, glasses, serving platters and cutlery.
The use of Wild Scottish Weddings umbrellas (hopefully not needed) and quaich (for your first drink).
A short, non-professional, 1–2-minute video of your wedding day taken by the Wild Scottish Weddings team.
Ensuring the wedding venue is clear once we leave and taking away of any rubbish.
Transport for up to 6 people.
Wedding Ceremony Location Scoping
Scoping of your wedding ceremony location during the planning phase to ensure it will be perfect for your day and to provide photos and video of potential ceremony spots.
The Wild Scottish Weddings All Inclusive Elopement Package,
Your perfect wedding day beautifully curated at a stunning ceremony location near Braemar which includes landowner fees and a plan B, wet weather option.
4 hours of picture-perfect photography (includes travel time between multiple photography locations).
An officiant to marry you including hand-tying cords to treasure.
Set up and serving of a luxury picnic including soft drinks.
Transport for up to 6 people.
Medium bouquet and buttonhole for the bride and groom.
A bagpiper to serenade you at your wedding ceremony location and whilst signing the marriage schedule.
A short video of your special day for personal and non-commercial use only and is not a substitute for professional videography services.
Conditions
Wild Scottish Weddings will act as Wedding Planner and/or Wedding Day Services Provider, depending on the services agreed and detailed on the Client's invoice.
Any timelines, schedules, recommendations or estimated costs provided by Wild Scottish Weddings are indicative only and do not constitute guarantees.
Clients using the Wedding Planning Service are responsible for making the final selection of all Suppliers. Wild Scottish Weddings will implement and coordinate the Client's decisions and instructions.
Clients using the Wedding Planning Service shall contract directly with Suppliers and are solely responsible for all payments made to those Suppliers.
Wild Scottish Weddings acts solely as an intermediary and coordinator when introducing or assisting with the engagement of Suppliers under the Wedding Planning Service. Any contract for goods or services supplied by a Supplier is between the Client and the Supplier directly. Wild Scottish Weddings shall not be liable for any act, omission, negligence, insolvency, cancellation, delay, failure to perform, or breach of contract by any Supplier.
Clients purchasing the All-Inclusive Elopement Package (for up to six people) will pay a single fee to Wild Scottish Weddings for the services included in the Package. Wild Scottish Weddings contracts with Clients as principal supplier of the Package and may engage third-party Suppliers to perform parts of the Package. Supplier services included within the Package will be selected by Wild Scottish Weddings, subject to availability. Wild Scottish Weddings reserves the right to select and substitute Suppliers of equivalent quality where reasonably necessary and at short notice. Wild Scottish Weddings remains responsible only for exercising reasonable skill and care in the selection and coordination of Suppliers.
Clients must notify Wild Scottish Weddings promptly of any changes that may affect the wedding arrangements or the services being provided. Wild Scottish Weddings shall not be liable for any consequences arising from late changes made by the Client.
Where a venue coordinator is present, Wild Scottish Weddings will work collaboratively with both the venue coordinator and the Client as required.
Wild Scottish Weddings will only use photographs or video footage featuring the Client for marketing, promotional material, website content, or social media with the Client's prior written consent.
Whilst every effort will be made to secure the Client's preferred ceremony location, availability will depend upon location permissions, capacity, accessibility, and availability on the chosen wedding date.
Please note that legal wedding paperwork, registration fees and any applicable visa or immigration costs are not included in our services or fees. Clients are responsible for completing all legal requirements relating to their marriage with the relevant Registry Office in Scotland and any other applicable authorities. Clients should also allow for any required appointments or visits to the Registry Office as part of the legal marriage process. Wild Scottish Weddings accepts no responsibility for any delay, cancellation or inability to proceed with the legal ceremony arising from incomplete, inaccurate or late submission of legal documentation by the Client.
Booking and Cancellation
You will be provided a quote for your requested services at the time of booking.
Wedding Planning Services
Wedding Planning Services fees are payable in full prior to work commencing. Wedding Planning involves the allocation of time, expertise and resources from the date of booking, with the majority of the planning work taking place immediately after commencement of the services. In the event of cancellation by the Client, Wild Scottish Weddings shall be entitled to retain sums reasonably reflecting work completed, administrative costs incurred and any non-recoverable payments made to Suppliers, and as such, the cancellation / refund policy is;
Cancellation Date : Refund
More than 13 weeks prior to the wedding ceremony date: a refund of 10%
13 weeks – 4 weeks prior to the wedding ceremony date : a refund of 5%
Less than 4 weeks prior to the wedding ceremony date: no refund
For Clients purchasing Wedding Planning Services, if the Clients cancel the wedding, Wild Scottish Weddings will assist with informing any Suppliers that Wild Scottish Weddings had assisted in arranging, on behalf of the Client. It is the responsibility of the Client to pay any required outstanding payments to Suppliers, negotiate the return of any payments for unused services if applicable and terminate any future payments with Suppliers. Any deposits paid will be lost.
Wedding Day Services
Wedding Day Services fees will be invoiced 6 weeks prior to the wedding ceremony date and are payable in full, at least 4 weeks prior to the wedding ceremony date and are non-refundable.
Wedding Ceremony Location Scoping
Where the Client procures Wedding Ceremony Location Scoping from Wild Scottish Weddings, costs are payable in full prior to services commencing. These are non-refundable if the Location Scoping has taken place and in the event of cancellation by the Client prior to the Location Scoping taking place, Wild Scottish Weddings shall be entitled to retain sums reasonably reflecting loss of earnings, work completed, administrative costs incurred and any non-recoverable payments made to Suppliers.
All-Inclusive Elopement Package
Clients purchasing the All-Inclusive Elopement Package (for up to six people) will be required to pay a deposit of 50% prior to work commencing, to cover wedding planning services and non-refundable Supplier deposits. Wedding planning services and Supplier procurement involves the allocation of time, expertise and resources from the date of booking, with the majority of the planning work taking place immediately after commencement of the services.
The remaining 50% fees will be invoiced for 15 weeks prior to the wedding ceremony date and are payable in full at least 13 weeks prior to the wedding ceremony date. Wild Scottish Weddings shall be entitled to retain sums reasonably reflecting work completed, administrative costs incurred and any non-recoverable payments made to Suppliers, and as such, the cancellation / refund policy is;
Cancellation Date : Refund
More than 13 weeks prior to the wedding ceremony date: refund of 10%
Less than 13 weeks prior to the wedding ceremony date : no refund
If the Clients purchase the All-Inclusive Elopement Package within 13 weeks of their ceremony date, then the Package fees are payable in full and are non-refundable.
If Clients wish to terminate the services of Wild Scottish Weddings this should be made in writing.
Wild Scottish Weddings reserve the right to review fees or terminate the agreement where the scope of the wedding materially changes from that agreed at the time of booking and a revised agreement cannot be reached between both parties. In this event, Wild Scottish Weddings reserves the right to retain sums reasonably reflecting work completed and costs incurred.
Rescheduling
Where the Client’s wedding date is required to be rescheduled, Wild Scottish Weddings may assist with the rescheduling of the wedding, depending on availability, within 12 months of the original wedding date, unless otherwise agreed. If there are any costs associated, these will be discussed and agreed with Clients. Wild Scottish Weddings reserves the right to charge an administration fee for multiple reschedules. Wild Scottish Weddings accepts no responsibility should the Clients incur additional costs from Suppliers associated with the rescheduling or should Suppliers be unavailable for the preferred rescheduled date.
Force Majeure
Wild Scottish Weddings shall not be liable for any delay, cancellation, alteration, or failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to, severe weather, flooding, wildfire, road closures, government restrictions, pandemics, industrial action, power outages, Supplier failure, illness, accidents, or acts of God.
Wild Scottish Weddings shall be entitled to retain payment for services already performed and costs already incurred.
Weather
Wild Scottish Weddings accept no responsibility for the Clients, wedding guests, wedding ceremony, photographs, reception, use or supply of any goods or services or for Suppliers being impacted, disrupted or cancelled by the weather conditions, in the days leading up to the wedding day or on the wedding day. Decisions regarding the safety and suitability of an outdoor location shall be made solely by Wild Scottish Weddings and/or any appointed Mountain Leader.
Wedding Attendance
Wild Scottish Weddings accept no responsibility for the Clients, wedding guests or Suppliers being unable to attend the wedding for any reason. Where possible, alternative Suppliers will be sought.
Participation and Medical Details
For outdoor weddings, where Wild Scottish Weddings staff are in attendance, Wild Scottish Weddings understands that outdoor weddings, particularly those in mountainous and remote locations can be hazardous.
All weddings are planned with the safety of our Clients and their wedding party in mind and we welcome custom from all abilities. Clients must complete a participation form on behalf of themselves prior to the wedding day and are requested to also inform us of any information pertaining to their guests that may be required by us from a safety perspective, such as food allergens. For remotely located weddings, guests may also be requested to complete a participation form.
Clients warrant that all information supplied regarding health conditions, medications, mobility requirements and allergies is complete and accurate. Depending on the location of the wedding, the participation form may ask for the following details; emergency contact information, medical conditions (including allergies) and medications. These details will only be used to help build the right wedding trip and we will of course discuss this with you if we have any concerns. If the wedding ceremony is at a location that is inaccessible by emergency services, then the form will also be used by our Base Camp (the team that looks after everyone’s safety while we are out on location). The Base Camp will commence emergency procedures should the wedding party fail to return or should the wedding guide call them. By signing the form, Clients and/or guests agree that we can pass on their details to the emergency services, Police and Mountain Rescue. This event is extremely unlikely.
For remotely located weddings, where a Wild Scottish Weddings qualified Mountain Leader is in attendance, and by agreeing to be guided by the Mountain Leader, the wedding party agree to accept the risks and will be responsible for their own actions. We refer you to the following statement from Mountaineering Scotland "Mountaineering Scotland recognises that climbing and mountaineering are activities with a danger of personal injury or death. Participants in these activities should be aware of and accept these risks and be responsible for their own actions and involvement". Our Mountain Leader qualified guides are responsible for the safety of the wedding party whilst on location and during the wedding ceremony. To manage the risk, Clients are requested to make their Mountain Leader aware should they feel unhappy or feel the activity is beyond their ability. No one will be required to undertake any activity with which they are not comfortable. By agreeing to continue, the wedding party accept responsibility for the risks.
Wild Scottish Weddings reserve the right to use any member of our team as a guide on your wedding day.
Clients are responsible for the conduct of their guests. Wild Scottish Weddings reserve the right to stop any wedding trip if any member(s) of the wedding party acts irresponsibly, unsafely or is abusive. Additional charges will apply if the offending client(s) have to be escorted off the trip by an additional guide. The Client shall be responsible for any reasonably foreseeable losses, damages or expenses caused by the misconduct, negligence or breach of these Terms by the Client or their guests.
Wild Scottish Weddings keep a close eye on the weather forecasts before we set out on the wedding trip. We reserve the right to modify the wedding trip or location to ensure you continue to have an enjoyable and safe experience with Wild Scottish Weddings. Our guides are trained to interpret the weather on the hills and will take the necessary actions to keep the group safe.
If anyone becomes unwell or has an injury during the trip, we will use our first aid training to look after their wellbeing until we return or evacuate immediately if required.
Please note, we do not accept liability for incidents arising from the effects of Clients or their guests consuming any intoxicating substances, therefore you do so at your own risk.
Insurance
Clients are strongly advised to take out wedding insurance to cover costs in the event that their wedding has to be postponed or cancelled and personal accident insurance.
Wild Scottish Weddings have public liability insurance.
Limitation of Liability
To the fullest extent permitted by law, Wild Scottish Weddings' liability for any claim arising from the provision of its services shall be limited to the amount paid by the Client for those services. Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability which cannot legally be excluded.
Wild Scottish Weddings shall not be liable for any indirect, consequential or economic loss including loss of enjoyment, disappointment, travel costs, accommodation costs or loss of opportunity.
Governance
These Terms and Conditions shall be governed by and construed in accordance with the laws of Scotland. Any dispute arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the Scottish Courts.
Intellectual Property
All itineraries, schedules, guides, location recommendations, photographs, videos, planning documents and other materials created by Wild Scottish Weddings remain the intellectual property of Wild Scottish Weddings and may not be reproduced, distributed or used for commercial purposes without prior written consent.
Clients grant Wild Scottish Weddings a non-exclusive licence to use photographs, text and other materials supplied by them solely for the purpose of providing the Services.
Data Protection
Wild Scottish Weddings will only share personal information with Suppliers and service providers where necessary for the planning and delivery of the wedding or where required by law. Special category personal data relating to health will only be processed where necessary for health and safety purposes and in accordance with applicable data protection legislation. Personal information will otherwise be handled in accordance with our Privacy Policy and applicable UK data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Complaints Procedure
Any complaint regarding the Services must be submitted in writing within fourteen (14) days of the wedding date. Wild Scottish Weddings will acknowledge the complaint within seven (7) days and endeavour to resolve the matter promptly and fairly.
Nothing in these Terms and Conditions affects the Client's statutory rights.
No variation to these Terms and Conditions shall be effective unless agreed in writing by both parties.
